Terms & Conditions
§ 1 Scope
These Terms and Conditions apply to all contracts between Gesa Jansen, Kampstraße 34, 22113 Oststeinbek, Germany (hereinafter "Provider") and the customer via the online shop www.bygesa.de.
§ 2 Contracting Party, Customer Account
(1) The purchase contract is concluded with Gesa Jansen.
(2) Registration and creation of a customer account is required before placing an order. The customer is obliged to keep their login credentials confidential.
§ 3 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
(2) By clicking the order button, the customer submits a binding offer to purchase. The contract is concluded upon confirmation by email or by activation of the product in the customer account.
§ 4 Prices and Payment
(1) All prices are final prices including statutory VAT.
(2) Payment is made via Stripe or PayPal. The invoice amount is due immediately upon ordering.
§ 5 Delivery of Digital Content
Upon receipt of payment, the digital products (sewing patterns and instructions) are immediately made available in the customer's account.
§ 6 Right of Withdrawal
(1) Consumers generally have a 14-day right of withdrawal.
(2) The right of withdrawal expires for digital content not delivered on a physical medium if the Provider has begun performance of the contract after the customer has expressly consented to the Provider beginning performance before the expiry of the withdrawal period, and the customer has confirmed their knowledge that they lose their right of withdrawal upon commencement of performance.
§ 7 Usage Rights
(1) With the purchase, the customer acquires a simple, non-transferable right of use for private purposes.
(2) Distribution, reproduction, publication, or commercial use of the sewing patterns and instructions is not permitted.
§ 8 Warranty
Statutory warranty rights apply.
§ 9 Liability
(1) The Provider is fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
(2) In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations, limited to foreseeable, typical damages.
§ 10 Final Provisions
(1) The law of the Federal Republic of Germany applies.
(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
